  • Shaw Gussis Fishman Glantz Wolfson & Towbin LLC is one of the nation's pre-eminent commercial insolvency, real estate and litigation firms. Its attorneys are leaders in their respective fields, providing counsel and representation to a wide variety of clients. David L. Shaw and Randy S. Gussis formed the firm Shaw & Gussis in 1988, specializing in commercial real estate law. In 1998, Robert M. Fishman, Robert W. Glantz and Brian L. Shaw joined the firm, bringing with them a thriving insolvency and bankruptcy practice. The firm expanded its practice into commercial litigation in 2000 with the addition of Jeffrey L. Widman, who has subsequently been joined in the litigation practice by George J. Spathis and Richard A. Saldinger. In 2002, the late Larry M. Wolfson joined the firm as a member and Jay S. Geller joined as counsel to add tremendous depth and additional experience to our Chapter 11 practice. In 2003, Samuel P. Gussis joined the firm, greatly expanding our commercial real estate practice. In 2003, Steven B. Towbin and Peter J. Roberts joined the firm's bankruptcy practice, making it one of the most sophisticated and experienced bankruptcy practice groups in the country. In 2004, Richard M. Fogel, a bankruptcy trustee with 25 years of experience, brought his practice to the firm. In 2006, Ira Bodenstein, former United States Trustee in Chicago, joined the bankruptcy group. The firm currently has grown to twenty-seven attorneys, eighteen in the bankruptcy/litigation group and nine in the commercial real estate group. Our bankruptcy/insolvency practice is amongst the most extensive and sophisticated in the United States. We represent debtors, debtors in possession, trustees, committees, and creditors in all phases of financial distress and the disputes attendant thereto. We are involved in large national cases and smaller regional and local situations. Our attorneys have substantial experience in insolvency related litigation of all varieties. We regularly represent parties in the purchase/sale of assets in financial distress situations. The co-chairmen of our insolvency practice, Robert M. Fishman and Steven B. Towbin, are Fellows of the American College of Bankruptcy, an honorary professional and educational association of bankruptcy and insolvency professionals. Nominees are extended an invitation to join this prestigious association based on a proven record of the highest standards of professionalism and service to the profession. Other members of the group also have extensive experience representing parties in complex bankruptcy and reorganization cases, as well as receivership and out-of-court workouts, and offer an aggressive but pragmatic approach to solving problems and obtaining results. Each of the members of our commercial litigation practice have experience in all aspects of state and federal commercial litigation, including contract claims, fraud claims, labor and employment disputes, products and premises liability claims, and construction and real estate disputes. Our commercial litigation group also lends continual support to our insolvency practice through its extensive involvement in the numerous adversary proceedings handled by our office, such as preference and fraudulent conveyance cases. The real estate practice at Shaw Gussis is diverse and extensive. Our attorneys provide representation with respect to all aspects of commercial and residential real estate. Our commercial real estate lending practice specializes in conduit loan origination and mezzanine financing nationwide, and our clients include community banks, private equity funds and Wall Street investment banks in originating loans. The firm also represents servicers and trustees on loans that have been securitized, bringing experience with every stage of a loan to the firm's clients. We have particular strength in tenant-in-common ("TIC") financing, and Sam Gussis is a frequent panelist on this topic at industry meetings and conferences. Shaw Gussis also has a very significant real estate development practice, involving acquisitions, land use and entitlement, Planned Developments dispositions, financing and leasing. The firm's clients include developers of shopping centers, office buildings and residential projects throughout the greater Chicagoland area.
